Syncrude is trying to keep some statements employees made about dead ducks in a tailings pond under wraps.
The Edmonton Journal is asking to see the statements, but a Syncrude lawyer warned a judge that it could result in a mistrial, because some of the evidence isn’t admissible in court.
Journal lawyer Fred Kozak says the court shouldn’t need to say no, because Syncrude is in a judge-only trial and there’s no jury to be influenced by newspaper articles.
The company is facing provincial and federal charges after more than 1,600 ducks died in one of its tailings ponds in 2008.
