Ski buddy not responsible for death

A B.C. widow has lost her lawsuit against the man she blames for her husband’s death while on a ski trip.

A Supreme Court Justice has ruled no “ski buddy” should have to shoulder the blame for the dangers that come with navigating the province’s back country.

Mark Kennedy was killed in 2009 while heli-skiing in the B.C. interior, after falling into a tree well and suffocating in snow.

Adrian Coe was picked as Kennedy’s buddy by their guide that day, and the pair had never met before.

A judge said Coe held up his end of a “gentleman’s agreement” to look out for his “ski buddy”, alerting guides within minutes that Kennedy was missing, and that Kennedy knew he was participating in a high risk sport.
