A Calgary judge has ruled a city man is guilty of aggravated sexual assault for passing HIV to his unsuspecting new wife.
The Calgary Sun reports the man, who cannot be named in order to protect the victim’s identity, withheld his health condition from her.
As a result, provincial court Judge Gord Wong ruled the wife’s consent to having sex with the man was gained through fraud, making it a crime.
The 30 year old Sudanese native met the victim in May of 2011 and they married a few months later.
She tested positive for HIV when she found out she was pregnant.
Sentencing is set for mid-January.
