Calgary police officer off the hook for drunk driving

A Calgary police officer has been acquitted of drunk driving because the results of his breathalyzer test have been dismissed.

Detective Travis Dunkle was suspended with pay after he was pulled over at a check-stop back in January 2009. A breathalyzer test showed he was driving over the legal limit.

But a provincial court judge has ruled the demand for the breathalyzer was unreasonable because there was no proof of Dunkle being impaired.

The judge said the breathalyzer test violated the detective’s Charter rights, adding
allowing such evidence could lead to other officers being more careless when following the Charter.

This drunk driving charge was Dunkle’s third brush with the law, including an earlier alcohol-related charge.
