Marko Miljevic loses appeal

A Calgary man found guilty of using a pickaxe to kill a teen has lost his bid to have his second-degree murder conviction overturned.

Marko Miljevic admitted to hitting Matt McKay at a house party in September 2007, but argued at his trial that he never intended to kill the 17-year-old.

Miljevic’s lawyer argued before the Supreme Court that the jury was not properly instructed on the definition of manslaughter.

But the high court says a proper explanation was given and ruled 4-3 to uphold the conviction.
